These Terms and Conditions ("Terms") form a legally binding agreement between you and Bela Apps ("we," "us," or "our") governing your access to and use of the ProofPass mobile application and any associated services (collectively, the "Service"). Please read them carefully before using ProofPass.
By downloading, installing, or using ProofPass in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not download or use the application.
Acceptance of Terms
By downloading, installing, creating an account in, or otherwise accessing ProofPass, you acknowledge that you have read these Terms, understand them, and agree to be legally bound by them, together with our Privacy Policy, which is incorporated herein by reference.
If you are using ProofPass on behalf of an organization or entity, you represent and warrant that you have authority to bind that organization to these Terms, and that "you" as used throughout these Terms refers to both you personally and that organization.
If you do not agree to these Terms in their entirety, you must immediately cease all use of the application and uninstall it from your devices. Continued use of the Service after any revision to these Terms constitutes your acceptance of those changes.
Description of Service
ProofPass is a mobile application designed to help individuals organize, store, and manage their purchase receipts, product warranties, return windows, and related product information in a private and secure environment. Core features include receipt capture via camera and OCR technology, warranty tracking, return-deadline reminders, safety recall alerts (sourced from the U.S. Consumer Product Safety Commission), AI-powered item categorization, and the ability to generate shareable "Proof Packs" for disputes and claims.
The Service is offered in the following tiers:
- Free Tier: Available to all users indefinitely, with storage and feature limitations as described on our pricing page.
- Pro Tier: A paid subscription that unlocks expanded storage, advanced features, and priority support. Available on a monthly, annual, or lifetime basis.
ProofPass is available for download on iOS devices via the Apple App Store and on Android devices via the Google Play Store. Feature availability may vary between platforms. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, though we will make reasonable efforts to provide advance notice of material changes.
User Accounts
ProofPass offers two modes of use, each with distinct account and security considerations:
- Local Mode (No Account Required): You may use ProofPass entirely on-device without creating an account. In Local Mode, all your data is stored exclusively on your device and protected by a PIN you set at setup. You are solely responsible for remembering and safeguarding your PIN. Bela Apps has no ability to recover a lost PIN or restore data in Local Mode — loss of your PIN or your device, or uninstalling the app, may result in permanent, irrecoverable data loss.
- Google or Email Account (Cloud Sync): You may optionally sign in with a Google account or a valid email address to enable cloud backup and multi-device sync. If you use this mode, you represent that all information you provide is accurate, current, and complete, and you agree to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- Age Requirement: You must be at least 13 years of age to create an account or use ProofPass. If we become aware that a user under 13 has registered, we will promptly delete their account and associated data. If you are between 13 and 18 (or the applicable age of majority in your jurisdiction), you may only use the Service with the knowledge and consent of a parent or legal guardian.
- Account Security: You agree to notify us immediately at [email protected] if you suspect any unauthorized access to your account. Bela Apps is not liable for losses resulting from unauthorized account use when such use arises from your failure to maintain adequate security of your credentials.
Subscriptions & Payments
ProofPass offers the following subscription plans. All prices are listed in U.S. dollars (USD) and are subject to change with reasonable advance notice:
Billing & Processing: All subscription billing is processed exclusively through Google Play (Android) or the Apple App Store (iOS). Bela Apps does not directly collect, store, or process your payment card or financial information. By subscribing, you agree to the billing terms of the applicable app store.
- Auto-Renewal: Monthly and Annual subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your app store account will be charged within 24 hours before each renewal period begins.
- Cancellation: You may cancel your subscription at any time through your Google Play or Apple App Store account settings. Cancellation takes effect at the end of the current paid billing period; you will retain Pro access until that date. No partial refunds are issued for unused time remaining in a billing period.
- Refunds: All refund requests must be submitted directly to Google Play or Apple App Store in accordance with their respective refund policies. Bela Apps has no ability to issue refunds for in-app purchases processed through the app stores.
- Price Changes: We reserve the right to adjust subscription prices. Any price change will be communicated to active subscribers in advance and will take effect at the next renewal cycle.
- Lifetime Plan: The Lifetime plan grants access to Pro features for the life of the ProofPass product as offered by Bela Apps. In the unlikely event that the Service is permanently discontinued, no refund will be offered beyond what is mandated by applicable app store policies.
Free-tier users retain full access to core features indefinitely. Upgrading to Pro is entirely optional and unlocks enhanced storage capacity, advanced export options, and priority support.
Acceptable Use
You agree to use ProofPass only for lawful purposes and in a manner consistent with these Terms. The following activities are expressly prohibited:
- Reverse Engineering: You may not decompile, disassemble, reverse-engineer, or attempt to derive the source code of ProofPass or any of its components.
- Illegal Use: You may not use ProofPass to facilitate any illegal activity, including but not limited to fraud, money laundering, tax evasion, or the submission of falsified documents in legal or insurance proceedings.
- Security Circumvention: You may not attempt to bypass, disable, or tamper with any security, encryption, or authentication features of the application or our infrastructure.
- Third-Party Data: You may not use ProofPass to store, organize, or process personal data belonging to other individuals without their explicit informed consent and in compliance with applicable privacy laws.
- Automated Access: You may not scrape, crawl, or otherwise automate access to the Service, its APIs, or its backend systems without our prior written permission.
- Malicious Content: You may not upload files or content that contain viruses, malware, or any code designed to interrupt, damage, or limit the functioning of ProofPass or any connected systems.
- Misrepresentation: You may not impersonate any person or entity, or falsely claim an affiliation with any person or organization in connection with your use of the Service.
We reserve the right to investigate suspected violations of these rules and, where appropriate, to suspend or permanently terminate the accounts of users who engage in prohibited conduct.
Data & Privacy
Your privacy is central to how ProofPass is designed. Your use of the Service is also governed by our Privacy Policy, which explains in detail what data we collect, how we use it, and how we protect it. The Privacy Policy is incorporated into these Terms by reference.
- Local Mode: When you use ProofPass in Local Mode, your receipts, warranties, and all associated data are stored exclusively on your device. This data is never transmitted to, or accessible by, Bela Apps or any third party. You bear full responsibility for device backups and data security in this mode.
- Cloud Sync: If you opt into cloud sync by signing in with a Google or email account, your data will be encrypted and stored on our secure cloud infrastructure to enable backup and cross-device access.
- Data Loss: Bela Apps is not responsible for data loss arising from device damage, theft, loss, factory reset, application uninstall, or — for Local Mode users — loss of PIN access. We strongly encourage all users to maintain independent backups of important documents.
- Third-Party Services: ProofPass integrates with third-party services for recall data (CPSC), OCR processing, and AI-powered categorization. Use of these features is subject to those providers' terms and privacy policies as disclosed in our Privacy Policy.
- Data Deletion: You may request deletion of all your ProofPass data at any time by navigating to Settings → Delete All My Data within the app. Cloud-account users may also submit a deletion request to [email protected].
Important: For Local Mode users, there is no mechanism for password recovery or data restoration if you forget your PIN or lose your device. Please ensure you store critical documents in multiple secure locations.
Intellectual Property
ProofPass, including its name, logo, user interface design, source code, iconography, written content, and all associated features and functionality, is owned by Bela Apps and protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
Subject to your compliance with these Terms, Bela Apps grants you a limited, non-exclusive, non-transferable, revocable license to download and use the ProofPass application on your personal device(s) solely for your personal, non-commercial purposes.
You agree that you will not, without express prior written permission from Bela Apps:
- Copy, reproduce, distribute, or publicly display any part of the ProofPass application or its branding materials;
- Create derivative works based on the ProofPass application or its design;
- Use the ProofPass name, logo, or trademarks in any manner that implies affiliation with or endorsement by Bela Apps;
- Sell, sublicense, rent, or otherwise transfer your access rights to any third party.
All rights not expressly granted herein are reserved by Bela Apps. Your content — meaning the receipts, photos, and product data you store in the app — remains yours. You grant Bela Apps only the limited rights necessary to provide and improve the Service as described in our Privacy Policy.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BELA APPS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement;
- Any guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components;
- Any warranty regarding the accuracy, completeness, timeliness, or reliability of recall data sourced from the U.S. Consumer Product Safety Commission (CPSC) or other third-party data providers — such data may be delayed, incomplete, or occasionally inaccurate;
- Any warranty that OCR scanning, AI categorization, or warranty-expiration detection will be error-free or suitable for your specific needs;
- Any warranty that the Service will meet your requirements or produce specific results.
You acknowledge that your reliance on any recall alerts, warranty timelines, or return-window calculations generated by ProofPass is at your own risk. We recommend always verifying critical information independently against your original purchase documents and official manufacturer or retailer communications.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BELA APPS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Service;
- Financial losses, missed return or warranty windows, or unrealized refunds resulting from inaccurate or delayed data within the app;
- Harm or injury arising from your reliance on recall alerts, recall data, or safety information provided through the Service;
- Loss or corruption of your stored receipts, warranties, or other data, whether due to device failure, app malfunction, or any other cause;
- Damages arising from unauthorized access to your account or data resulting from your failure to maintain adequate security of your credentials or device.
In any event, our total cumulative liability to you for all claims arising out of or relating to these Terms or your use of the Service shall not exceed the greater of: (a) the total amount you have paid to Bela Apps via in-app purchases during the twelve (12) months immediately preceding the claim, or (b) USD $10.00.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability. If such restrictions apply in your jurisdiction, some of the above limitations may not apply to you, and your rights may be as described under applicable local law.
Termination
These Terms remain in effect for as long as you use the Service. Either party may terminate the agreement as described below:
- Termination by You: You may delete your account and all associated data at any time by navigating to Settings → Delete All My Data within the ProofPass app, or by contacting us at [email protected]. Deletion of your account terminates your use of the Service and, for subscribed users, does not automatically cancel your subscription — you must cancel separately through your app store account settings.
- Termination or Suspension by Bela Apps: We reserve the right to suspend, restrict, or permanently terminate your access to the Service, with or without prior notice, if we believe that you have violated these Terms, engaged in fraudulent or illegal activity, or posed a security risk to other users or our systems.
- Effect of Termination: Upon termination of your account, your right to use the Service immediately ceases, and we will delete or anonymize your data in accordance with our Privacy Policy and applicable law. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and governing law — shall continue to apply.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and, for material changes, provide in-app notification to users who have accounts with us. We may also send an email notification to registered users where we have a current email address on file.
Your continued use of ProofPass following the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service and, if applicable, cancel any active subscription through your app store account settings.
We encourage you to review these Terms periodically to stay informed of any updates. Non-material changes — such as grammatical corrections, formatting adjustments, or minor clarifications that do not alter your rights or obligations — may be made without specific notice.
Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with applicable law, without regard to its conflict-of-law provisions. You agree to comply with all applicable local, national, and international laws in connection with your use of the Service.
Informal Resolution: Before initiating any formal dispute process, you agree to first contact us at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice.
Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Service shall be resolved through final and binding arbitration, rather than in court, except where prohibited by applicable law. You agree to waive any right to a jury trial and to participate in any class-action lawsuit or class-wide arbitration related to the Service.
Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm, including but not limited to infringement of intellectual property rights.
